to either of the officers of his brigade, and the commanding officer of
each regiment shall on or before the first of april next, and from time
to time thereafter as may be necessary, appoint some suitable person
or persons on such terms as he may deem advisable, to collect all fines
that may be imposed upon all company officers, non-commissioned
officers, privates and musicians of his regiment or on other persons
by or under the provisions of this act; and if any officer shall neglect
or refuse to comply with any of the provisions of this section as re-
quired of him, he shall be fined a sum not exceeding one hundred
dollars, in the discretion of such court martial as the case may re-
quire.

38. And be it enacted, That the president of each court martial or
other court, created under the provisions of this act, shall within
three days after the passing of any sentence of such court, return
such sentence in writing certified by said president to be the correct
sentence of the court, to the commanding officer of the division, bri-
gade regiment or company ordering the same; and in the returns
made by the courts of appeal on absentees from parade, it shall be
distinctly written opposite to the respective names of those whose

same, and it shall be the duty of the said commanding officer to
make out or cause to be made out two or more copies of every such
list of fines incurred, to retain one himself and deliver the other to

the case may require within ten days after receiving it, to be by
him or them collected as hereinafter provided, and when collected
shall account for with and pay over the same to the commanding of-
ficer by whom the said lists were placed in his or their hands, or to
his successor in office; Provided, the same shall be done subject to
such deduction for commission and other regulations as may have
keen established with the said officer, authorised by this act to ap-
point such collector or collectors; and if any officer shall neglect or
refuse to comply with any of the provisions of this section as require-

39. And be it enacted, That the president of each court martial, or
other court instituted under the provisions of this act, which shall
have the power of trying the major general, the brigadier generals and
their respective staff officers,for any violation of this act or of remitting
their fines, shall make a return of the sentence of said court in the
same manner, under the like penalty and within the time as specified
under this act for similar returns, except in the cases of fines, where
the return for the major general and his staff officers shall be made to
the commanding officer of the third brigade; and the return tor a bri-
gadier general and his staff officers shall be made to the oldest colo-
nel in rank, of the brigade to which he belongs, who shall place the
same in the hands of the collector appointed to collect all fines and
forfeitures against field and staff officers of his brigade, and when re-
ceived shall be paid over by said officer in equal portions to the dif-
ferent regiments of said brigade.

imposed by division, brigade, regimental and company courts martial
