left at his place of residence, within ten days after receiving the
same, under the penalty of ten dollars current money for every
neglect by the sheriff or clerk respectively; and if any person ap-
pointed supervisor as aforesaid, shall not lodge his warrant with
the county clerk within fifteen days after he shall receive the same,
he shall be considered as accepting the appointment, and may be
proceeded against for neglect of duty accordingly.

5. And be it enacted, That whenever the public roads shall
want repairs, except in wheat harvest, it shall be the duty of each
supervisor to call on all persons within his district, or as many as he
may deem necessary, who shall have paid county taxes, or shall be
charged with the same, (except persons owning water mills over
which a public road leads,) at least two days before he intends work-
ing on said roads, and to notify them of his intentions, and the
place and hour of meeting, and what tools they must furnish,
whose duty it shall be to attend at the hour appointed with such
tolls as shall be required, with all their able bodied males which

belong to them, or are in their employ and under their control; Pro-
vided, That no female, or white male over fifty years of age, or
under twenty-one years of age, nor any slave over sixty years of age
or under eighteen years of age, shall be obliged to attend or work;
but it shall be their duty to furnish all able bodied males within said
ages, and to attend themselves, if males, and within the ages afore-
said, whenever required as aforesaid, under a penalty not exceeding
seventy-five cents nor under fifty cents for every hand or person so re-
quired, to be recovered in the name of the state, by the supervisor,
before a justice of the peace in said county, as other small debts
are; which shall be accounted for by the supervisor on oath to the
Levy Court; and the supervisor may receive any fine as aforesaid
without a warrant, and account for the same as aforesaid.

6. And be it enacted, That it shall be the duty of the super-
visor to direct each free male person of color, above the age of
twenty-one years, and under the age of fifty years, residing within
his district, to meet upon the day, and at the place appointed for
such purpose by the supervisor aforesaid, and to labor in repairing
the said public roads, under the same regulations and penalties as
other persons.

7. And be it enacted, That it shall be the duty of each su-
pervisor, to make such commutation of labor for team and carts
or wagons at the time of such notice as he may think proper, and
to appoint an early hour in each day to commence working on the
road, and continue the hands, when necessary, to a late hour in each
day, and to see that each hand does his duty on the road.

8. And be it enacted, That if any of the supervisors appointed
by this act, shall not sufficiently clear, amend and keep in good order
and repair, the public roads within his district, or shall suffer any
fallen trees or other obstructions, to remain in or across any of the
said public roads whereby any cart, wagon or other carriage may
be obstructed for more than three days together, he having notice
thereof, or shall neglect to fall all dead trees on either side of the
said public roads, whose limbs hang over, and may by their falling
injure travellers, or to lop or cut off all limbs or branches of trees
hanging or projecting over the road, within fifteen feet above the
surface thereof, or shall suffer any of the bridges or cause-ways to
