expiration of ten years from and after the passing of this act; and
if the Baltimore and Havre-de-Grace turnpike company shall not,

within the said ten years, complete the said road, forty feet wide,
of which at least twenty feet wide shall be composed of stone,
gravel, or other hard substance, it shall be lawful for the legislature
of this state to resume the rights, privileges, liberties and franchi-
ses granted to said company by the said original act.

chapter 170.
An Act for the relief of Ann Merryman of Baltimore.
Be it enacted By the General Assembly of Maryland, That the
said Ann Merryman, be and she is hereby divorced from bed, board
and mutual cohabitation with her husband William Merryman.

CHAPTER 171.

An act concerning Lower Marlborough Academy.
Whereas, Calvert county was heretofore associated with Saint
Mary's, Charles and Prince George's in the management of Char-
lottte Hall School, and the state having since the said association
granted divers donations for the benefit of said school, to be enjoy-
ed in common by the counties above named; And whereas, it is now
represented that the academy of Lower Marlborough in Calvert
county has been re-built, and that if the same could be re-organized
and endowed with a small donation, it would become of much great-
er benefit and advantage to the citizens of Calvert county, than any
they now receive from Charlotte Hall School—Therefore,

Preamble.

Sec. 1. be it enacted By the General Assembly of Maryland,
That from and after the passage of this act, one fourth part of the
donations granted by the state to the trustees of Charlotte Hall
School, after deducting one fourth part of the annual interest due
to this state on the loan heretofore granted to Charlotte Hall, shall
be paid by the treasurer of the western shore to the trustees of
Lower Marlborough academy herein after named; and the said
trustees and their successors shall forever hereafter be entitled to
receive the said fourth part of said donations for the use and bene-

fit of the said academy.

2. And be it enacted, That Richard Grahame, Thomas H.
Wilkinson, John G. Machall, John Beckett, Daniel Kent, Isaac.
Rawlings and David C. Lyles, are hereby constituted and appoint-
ed trustees of the Lower Marlborough academy, to have perpetual
succession as such in the same manner that the trustees of Lower
Marlborough academy formerly had; and they are hereby invested
with all the rights and advantages given to the trustees of said aca-
demy, by the provisions of an act of assembly passed at December
session seventeen hundred and seventy-eight, chapter sixteen.

CHAPTER 172.

An act to incorporate a company to erect a shot tower in or adjacent
to the City of Baltimore.
Sec. 1. Be it enacted By the General Assembly of Maryland,
That a company be incorporated to erect a shot tower in or adja-
cent to the city of Baltimore; and that said company be, and is
hereby created and declared to be a body politic and corporate by
the name and style of The President and Directors of the Shot Tow-
