107. Any person violating any of the provisions of this sub-title
shall be deemed guilty of a misdemeanor and shall, upon conviction
thereof, be subject to a fine of not more than One Thousand Dollars
($1,000) or to imprisonment for not more than ninety (90) days or
to both such fine and imprisonment.

Sec. 2. And be it further enacted, That new Section 670A be and
it is hereby added to Article 27 of the said Code (1951 Edition), title
"Crimes and Punishments", to follow immediately after Section 670
thereof, to be under the new sub-title "Wire-tapping", and to read
as follows:

Wire-tapping

670A. Any person or persons who shall willfully intercept or tap
any telephonic or telegraphic communications in any manner other
than pursuant to an order under the provisions of Sections 100 to
107, inclusive, of Article 35 of the Annotated Code of Maryland (as
added by this Act to the 1951 Edition), shall be deemed guilty of a
misdemeanor and upon conviction thereof shall be subject to a fine
of not more than One Thousand Dollars ($1,000.00) or to imprison-
ment for not more than ninety (90) days or to both such fine and
imprisonment in the discretion of the Court. Provided, however, that
nothing in this section shall apply to the Federal Bureau of Investi-
gation or to any other federal investigating agency; and provided
further that nothing in this section shall apply to an employee or
authorized agent of a telephone or telegraph company, while engaged
in the official and authorized course of his employment.

SEC 3. And be it further enacted, That if any part, section, sub-
section, sentence, clause or phrase of this sub-title shall be held
unconstitutional or void for any reason, such decision shall not affect
the validity of the remaining portions of this sub-title, it being the
legislative intent that this Act shall be considered severable.

Sec. 4. And be it further enacted, That this Act shall take effect
June 1, 1956.

AN ACT to repeal and re-enact, with amendments, Section 65 (b) of
Article 48 of the Annotated Code of Maryland (1951 Edition),
title "Inspections", sub-title "State Tobacco Authority", providing
for a representative of the buyers of Maryland tobacco on the
Maryland Tobacco Authority and relating generally thereto.
