CHAPTER 107
(House Bill 52)
AN ACT to add Section 4 (c) to Article 73B of the Annotated Code
of Maryland (1951 Edition), title "Pensions", said new section to
follow after Section 4 (b) thereof, relating to contributions pay-
able by elected and appointed officials for membership service prior
to entrance into the Employees' Retirement System of the State of
Maryland.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 4 (c) be and is hereby added to Article 73B of the Anno-
tated Code of Maryland (1951 Edition), title "Pensions", said new
section to follow after Section 4 (b) thereof, and to read as follows:

(e) Any elected or appointed official who receives membership
service credit for service rendered to the State or to any county or
municipal corporation under the provisions of Section S (5) or Sec-
tion 6 (7) of this Article shall pay to the retirement system by a single
payment the contributions, with interest, which he would have paid
had he been a member of the retirement system between October 1,
1941 or the date he was elected or appointed, whichever is later, and
the actual date of entrance into the retirement system; except any
such member may waive the payment of any or all such contributions,
in which case upon retirement on or after July 1,1956 any ordinary
disability retirement allowance or any allowance due to non reappoint-
ment or non-reelection to any State office payable to such a member
shall be reduced by the actuarial equivalent of those contributions
which he had not paid, with interest to date of retirement.
The total retirement allowance that would have been payable to the
beneficiary had he not waived his contributions shall be used as the
basis for the determination of any supplemental payment under the
provisions of Section 11 (7) of this Article.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1,1956.
