nicipal corporations, INCURRING INDEBTEDNESS AND
ISSUING BONDS, PROVIDING FOR REFERENDA ON LOCAL
ACTS SETTING TAX RATES AND DEBT LIMITS, creating
new municipal corporations and repealing municipal charters
under said Article 11E, and relating generally to the government
of municipal corporations in this State, with the exception of the
City of Baltimore, under said Article HE of the Constitution of
Maryland.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Sections 9 to 33 43, inclusive, be and they are hereby added to
Article 23A of the Annotated Code of Maryland (1951 Edition and
1954 Supplement), title "Corporations—Municipal", said new sec-
tions to follow immediately after Section 8 of said Article and to be
under the new sub-title "Home Rule", Section 9 thereof to be under
the sub-heading "Definition" "DEFINITIONS AND LIMITA-
TIONS", Section 10 thereof to be under the sub-heading "Home
Rule Classification", Sections 11 to 18, inclusive, thereof to be under
the sub-heading "Charter Amendments", Section 19 thereof to be
under the sub-heading "Annexation", Sections 20 to 30, inclusive,
thereof to be under the sub-heading "Incorporation of Municipali-
ties", SECTIONS 31 TO 39, INCLUSIVE, THEREOF TO BE
UNDER THE SUB-HEADING "CREATION OF MUNICIPAL
PUBLIC DEBT", SECTION 40 THEREOF TO BE UNDER THE
SUB-HEADING "TAX RATES AND DEBT REFERENDA", Sec-
tions

"Automatic Repeal of Charter", and all to read as follows:

HOME RULE
DEFINITION DEFINITIONS AND LIMITATIONS

9. ("Municipal Corporation.") (A) As used in this sub-title, the
term "municipal corporation" shall include all cities, towns and
villages, now or hereafter created under any general or special law of
this State for general governmental purposes, which are subject to
the provisions of Article 11E of the Constitution of Maryland, which
possess legislative, administrative and police powers for the general
exercise of municipal functions, and which carry on such functions
through a set of elected and other officials. The term is not to include

ANY SPECIAL TAX AREA OR DISTRICT, SANITARY
DISTRICT, PARK OR PLANNING DISTRICT, SOIL CONSER-
VATION DISTRICT OR OTHER PUBLIC AGENCY EXERCISING
SPECIFIC POWERS WITHIN A DEFINED AREA BUT WHICH
DOES NOT EXERCISE GENERAL MUNICIPAL FUNCTIONS
AND THE TERM IS NOT TO INCLUDE THE MAYOR AND CITY
COUNCIL OF BALTIMORE. NOTHING HEREIN CONTAINED
SHALL BE CONSTRUED TO CONFER UPON ANY MUNICIPAL
CORPORATION, AS HEREIN DEFINED, LOCATED WITHIN
ANY SUCH TAX AREA OR DISTRICT, THE POWER BY INCOR-
PORATION, CHARTER AMENDMENT, ANNEXATION OR
OTHERWISE TO EXERCISE OR PERFORM, DIVEST OR
DUPLICATE, WITHIN ITS CORPORATE LIMITS ANY OF
THE SPECIAL POWERS OR DUTIES THERETOFORE CON-
FERRED UPON THE BOARD, COMMISSION, AUTHORITY
