title "State Roads", providing for the appointment by the State
Roads Commission of one or more Assistant Secretaries, who
shall so serve without additional compensation.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 1 of Article 89B of the Annotated Code of Maryland
(1951 Edition), title "State Roads", be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

1. The State Roads Commission shall consist of three members
to be appointed by, and to hold office during the pleasure of, the
Governor, one of whom he shall designate as Chairman of the Com-
mission. One of said members shall be a resident of the Eastern
Shore of Maryland, one a resident of the counties of the Western
Shore of Maryland and one a resident of Baltimore City or a person
who at the time of his appointment has, and for a period of at least
two years immediately prior thereto has continuously had, his prin-
cipal place of business, employment or professional activity in Balti-
more City. At least one member of said Commission shall bona fide
belong to or be affiliated with that one of the two leading political
parties in the State opposite to the party to which the Governor
belongs. The Governor shall have the power, in his discretion, to
remove any member of said Commission at any time, and to appoint
another qualified person in his stead, and to fill any vacancy caused
by death, resignation, incapacity, removal or other cause. The mem-
bers of said Commission shall take the oath prescribed by Article 1,
Section 6 of the State Constitution and shall receive such compen-
sation as may be provided for in the Budget. A majority of the
members of said Commission shall constitute a quorum for the trans-
action of business. The Chairman shall preside over its meetings and
perform such other duties as may be imposed upon him by law or
as may be assigned to him by the said Commission.

The members of said Commission shall elect a Secretary, not a
member of the Commission, who shall receive such compensation as
the Commission may determine and as may be provided in the
budget. He shall make and carefully preserve full and accurate
minutes of all meetings and records of all proceedings and enter
same in the journal of the Commission. The Secretary shall make
true copies of all notices directed by the Commission to be published
and the certificates of publication thereof, and shall perform such
other duties as may be imposed upon him by law or as may be
assigned to him by the Commission.

The members of the said Commission may also appoint from
among the employees of the Commission one or more Assistant Sec-
retaries who shall receive no additional compensation by virtue of
such appointment. Any Assistant Secretary so appointed, in the
event of the absence or disability of the Secretary or whenever so
instructed by the Chairman of the Commission, shall have all the
powers granted to and all the duties imposed upon the Secretary by
any provision of this Article 89B; and any act directed to be per-
formed by an Assistant Secretary.

SEC. 2. And be it further enacted, That this Act shall take effect
June 1, 1955.
