(Senate Bill 272)
AN ACT to repeal and re-enact, with amendments, Section 353 and
Section 368 of Article 27 of the Annotated Code of Maryland
(1951 Edition), title "Crimes and Punishments", sub-title "Health
—Narcotic Drugs", relating to the sale of narcotic drugs upon
an oral prescription and authorizing the State Department of
Health to issue regulations concerning the same.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 353 and Section 368 of Article 27 of the Annotated
Code of Maryland (1951 Edition), title "Crimes and Punishments",
sub-title "Health—Narcotic Drugs", be and they are hereby re«
pealed and re-enacted, with amendments, to read as follows:
353. A pharmacist in good faith, may sell and dispense narcotic
drugs to any person upon the written prescription of a physician,
dentist or veterinarian, provided it is properly executed, dated and
signed by the person prescribing on the day when issued and bears
the full name and address of the patient for whom or of the owner
of the animal for which, the drug is dispensed, or upon oral pre-
scription, in pursuance of the regulations promulgated by the Secre-
tary of the Treasury of the United States , OR HIS DELEGATE,
under the provisions of the Federal Narcotics Act as amended, and
regulations promulgated by the State Department of Health as here-
inafter set forth in Section 368 of this sub-title, provided said oral
prescription is promptly reduced to writing by the pharmacist, stat-
ing the name of the physician, dentist or veterinarian so prescribing,
the date bearing the full name and address of the patient for whom,
or of the owner of the animal for which, the drug is dispensed, and
in all instances, the full name, address and registry number under
the Federal narcotic laws of the person so prescribing if he is re-
quired by those laws to be so registered. If the prescription be for
an animal, it shall state the species of animal for which the drug is
