GENERAL CORPORATE POWERS
3. The inhabitants of each town included within the provisions
of this Article within the corporate limits legally established from
time to time are hereby constituted and/or continued a body corpo-
rate by the name of "The Town of " OR "THE CITY
OF " with all the privileges of a body corporate, by that
name to sue and be sued, to plead and be impleaded in any court of
law or equity, to have and use a common seal and to have perpetual
succession, unless the charter and the corporate existence are legally
abrogated.
Corporate Limits
4. The courses and distances showing the exact corporate limits
of the town shall be filed at all times with the Clerk of the Circuit
Court in the county in which the town is located, the Commissioner
of the Land Office and the Director of the Department of Legislative
Reference. In addition, if the town is already incorporated as a
municipal corporation, or as soon as it becomes incorporated and
begins functioning as such, a copy of the courses and distances
describing the corporate boundaries shall be on file in the office of
the Mayor or of the Town Clerk. All the officials named in this
section are hereby directed to file or record all such descriptions of
corporate boundaries so filed with them, each in a suitable book or
place, properly indexed and reasonably available for public inspec-
tion during normal business hours.
The Council
5. (Number, Selection, Term.) All legislative powers of the
town shall be vested in a council consisting of five Councilmen who
shall be elected as hereinafter provided and who shall hold office for
a term of four years or until the succeeding council takes office. The
regular term of Councilmen shall expire on the second Monday follow-
ing the election of their successors. Councilmen holding office at the
time this charter becomes effective shall continue to hold office for
the term for which they were elected and until the succeeding council
takes office under the provisions of this charter.
6. (Qualifications of Councilmen.) Councilmen shall have resided
in the town for at least one year immediately preceding their elec-
tion and shall be qualified voters of the town.
7. (Salary of Councilmen.) Each councilman shall receive an
annual salary which shall be equal for all Councilmen and shall be as
specified from time to time by an ordinance passed by the council
in the regular course of its business; provided, however, that the
salary specified at the time any council takes office shall not be
