448. The Commission shall be, and it is hereby authorized to pre-
scribe all needful rules and regulations for the administration and
enforcement of this sub-title.

449. All Acts and parts of Acts inconsistent with the provisions
of this sub-title are hereby repealed to the extent of their inconsist-
ency, provided that nothing herein contained shall be taken as re-
stricting any control which the State Board of Health of Maryland
and the Department of Geology, Mines and Water Resources are em-
powered to exercise within any sanitary districts.

SEC. 2. And be it further enacted, That this Act shall take effect
June 1, 1955.

Approved April 1, 1955.

CHAPTER 244
(House Bill 431)

AN ACT to repeal and re-enact, with amendments, Section 16 of
Article 31B of the Annotated Code of Maryland (1951 Edition),
as heretofore amended by Chapter 516 of the Acts of 1953, title
"Defective Delinquents", clarifying the authority of the Board of
Correction with respect to transfers by it of inmates of penal in-
stitutions to Patuxent Institution.

WHEREAS, It was the intent of the Legislature in adopting Section
4 (c) of Article 31B to confer upon the Board of Correction the au-
thority to transfer in its discretion inmates of the penal institutions
of the State to the Patuxent Institution for diagnosis and treatment
or for the purpose of employment at said Institution provided that
such transfer should not operate to extend the term for which any
such inmate was sentenced and without impairing any other rights
of such inmate; and

WHEREAS, The provisions of Section 4 (c) of Article 31B may have
been rendered inoperative by the broad provisions of Section 16 of
said Article and it is deemed advisable to so limit the provisions of
Section 16 as to clarify the authority of the Board of Correction
under Section 4 (c).

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 16 of Article 31B of the Annotated Code of Maryland
(1951 Edition) as heretofore amended by Chapter 516 of the Acts
of 1953, title "Defective Delinquents", be and it is hereby repealed
and re-enacted, with amendments, to read as follows:

16. (Article Construed Prospectively.)

Nothing in this article shall be construed to extend to or to affect any
person who on June 1,1954, is held an as AS AN inmate or prisoner of
