SEC. 2. And be it further enacted, That the provisions of this Act
shall apply only where the offense upon which a conviction calling
for capital punishment is based, shall occur on or after June 1, 1955.

SEC. 3. And be it further enacted, That this Act shall take effect
June 1,1955.1956.

CHAPTER 626
(House Bill 89)

AN ACT to propose an amendment to Section 11 of Article 2 of the
Constitution of Maryland, title "Executive Department", providing
that recess appointments of civil officers of the State shall be re-
turned on the first day of the next REGULAR session of the Senate
of Maryland for its adoption or rejection; and providing that this
amendment shall be submitted to the qualified voters of the State
for their adoption or rejection.

SECTION 1. Be it enacted by the General Assembly of Maryland,
(Three-fifths of all members elected to each of the two Houses con-
curring) , That the following amendment be and it is hereby proposed
as an amendment to Section 11 of Article 2 of the Constitution of
Maryland, title "Executive Department", the same, if adopted by the
qualified voters of the State, to become Section 11 of Article 2 of the
Constitution of the State of Maryland:

11. In case of any vacancy during the recess of the Senate, in any
office which the Governor has power to fill, he shall appoint some
suitable person to said office, whose commission shall continue in
force until the end of the next session of the Legislature, or until some
other person is appointed to the same office, whichever shall first
occur; and the nomination of the person thus appointed during the
recess, or of some other person in his place, shall be made to the
Senate [within thirty days after the next meeting of the Legisla-
ture.] on the first day of the next regular

SEC. 2. And be it further enacted, That said aforegoing section
hereby proposed as an amendment to the Constitution of the State of
Maryland shall, at the next general election to be held in November,
1956? be submitted to the legal and qualified voters of the State, for
their adoption or rejection, in pursuance of the directions contained
in Article 14 of the Constitution of the State of Maryland, and at the
said general election the vote on the said proposed amendment to the
Constitution shall be by ballot and upon each ballot there shall be
printed the words "for the Constitutional Amendment", and "Against
the Constitutional Amendment", as now provided by law, and im-
