CHAPTER 96
(House Bill 138)
AN ACT to add new Section 9 (45) to Section 9 of Article 81 of the
Annotated Code of Maryland (1957 Edition), title "Revenue and
Taxes", sub-title "What Shall be Taxed and Where", said new
Sub-section to follow immediately after Section 9 (44) thereof,,
authorizing the exemption from State and local property taxation,
of CERTAIN tangible personal property which is part of or neces-
sary for the efficient operation of nuclear research or testing
facilities.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That new Section 9 (45) be and it is hereby added to Section 9 of
Article 81 of the Annotated Code of Maryland (1957 Edition), title
"Revenue and Taxes", sub-title "What Shall be Taxed and Where",
said new Sub-section to follow immediately after Section 9 (44>
thereof, and to read as follows:

(45) Tangible personal property IN THE FORM OF MACHIN-
ERY, TOOLS AND SCIENTIFIC APPARATUS, INCLUDING
NUCLEAR REACTORS, PARTICLE ACCELERATORS AND
RADIATION SOURCES AND ASSOCIATED MEASURING, CON-
TROLLING, MATERIAL - HANDLING, PUMPING, COOLING
AND CONTAINMENT EQUIPMENT AND SPECIAL NUCLEAR
MATERIAL which is part of or necessary for the efficient operation
of a nuclear research or testing facility, in any county or city in
which by law, resolution or ordinance the same is or may be exempt
from county and/or city taxation; and the County Commissioners
of any county and any city are hereby authorized to pass such reso-
lution or ordinance. EXCEPT AS OTHERWISE PROVIDED IN
THIS ARTICLE, THIS EXEMPTION SHALL NOT BE CON-
STRUED TO APPLY TO ANY NUCLEAR REACTOR FOR THE
COMMERCIAL PRODUCTION OF ELECTRIC POWER.
SEC.2. And be it further enacted, That this Act shall take effect
July 1, 1958.

(House Bill 146)
AN ACT to propose an amendment to Section 3 of Article 7 of the
Constitution of Maryland, title "Sundry Offices", abolishing the
office of State Librarian and submitting this amendment to the
qualified voters of the State for adoption or rejection.
