CHAPTER 72
(House Bill 24)

AN ACT to repeal and re-enact, with amendments, paragraph (e)
of Sub-section (7) of Section 14 of Article 73-B of the Annotated
Code of Maryland (1957 Edition), title "Pensions", and to add a
new paragraph to said Sub-section (7) of said Section 14 of said
Article and title, said new paragraph to follow immediately after
paragraph (e) and to be known as paragraph (f); and to
repeal and re-enact, with amendments, paragraph (e) of Sub-
section (7) of Section 116 of Article 77 of the Annotated Code of
Maryland (1957 Edition), title "Public Education", sub-title
"Teachers' Retirement System", and to add a new paragraph to
said Sub-section (7) of said Section 116 of said Article, title and
sub-title, said new paragraph to follow immediately after para-
graph (e) and to be known as paragraph (f), to provide that
supplementary payments will not be made to certain beneficiaries
or members of the Employees' Retirement System of the State of
Maryland or the Teachers' Retirement System of the State of
Maryland, who are eligible to receive benefits under the Federal
Old Age and Survivors' Insurance System, and relating generally
to conditions of eligibility for such supplementary payments.

Section 1. Be it enacted by the General Assembly of Maryland,
That paragraph (e) of Sub-section (7) of Section 14 of Article 73-B
of the Annotated Code of Maryland (1957 Edition), title "Pensions",
be and the same is hereby repealed and re-enacted, with amendments,
and that a new paragraph be and it is hereby added to Sub-section (7)
of Section 14 of said Article and title, to be known as paragraph (f),
to follow immediately after paragraph (e) thereof, and all to read
as follows:

(7)

(e)  Provided that the retirement allowance used in calculating the
supplementary payment shall be the total benefits provided in Sec-
tion 11 of this Article except that it shall not be based on any optional
benefit chosen by the beneficiary or member [.] , and

(f) Provided that such beneficiary or member, EXCEPTING ANY
PERSON WHO MAY RETIRE FOR REASONS OF DISABILITY,

is not eligible to receive benefits from the Federal old age and sur-
vivors9 insurance system; but this sub-section shall not be construed
to affect or bar any person's right to receive supplementary payments
under this Article or any other laws of this State, if such person
was receiving such payments prior to June 1, 1958.

Sec 2. And be it further enacted, That paragraph (e) of Sub-
section (7) of Section 116 of Article 77 of the Annotated Code of
Maryland (1957 Edition), title "Public Education", sub-title "Teach-
