LAWS OF MARYLAND.

Riddlemoser, Andrew Annan and others, and for san-
atory purposes, and to prevent the introduction of con-
tagious diseases, the powers of the corporation shall
extend within one mile of the town.

Acts made
valid.

SEC. 3. And be it enacted, That the acts and
proceedings of the Burgess and Commissioners of Em-
mittsburg heretofore made and had in accordance with
the authority heretofore vested in the citizens of said
town by the act of the General Assembly of Maryland,
passed at December session eighteen hundred and
twenty-four, chapter twenty nine, entitled, an act to
incorporate Emmittsburg in Frederick county, and the
several supplements thereto, be and the same are here-
by made valid and binding in law, to all intents and
purposes, in so far as the same may not be inconsistent
with the provisions of this act; and all officers of
said town elected or appointed in accordance with the
authority aforesaid, shall fulfil their respective duties
agreeably to the provisions of this act, and the ordi-
nances of the said burgess and commissioners, until
they are succeeded in office in accordance herewith.

SEC. 4. And be it enacted, That the free white
male citizens of Emmittsburg aforesaid, above twenty-
one years of age, who shall have resided in said town
twelve months next preceding, shall on the first Mon-
day of May next, and on the same day in each and
every year thereafter, be authorised to elect by ballot,
a burgees and six commissioners for the said town, each
of whom shall have been an inhabitant thereof at least
twelve months next preceding the election, a citizen of
the United States, above twenty-five years of age, and
holding real properly in the said town; the said elec-
tion to be held at a central part of said town; the
polls to be kept open from nine o'clock in the morning
until two o'clock in the afternoon, and the said burgees
and commissioners shall severally continue and remain
in office until their successors are elected and qualified
to act as such.

election.

SEC. 5. And be it enacted, That the Burgess of
Emmittsburg for the time being, or on his neglect or
refusal so to do at the proper time, any justice of the
peace residing in Emmittsburg shall appoint by writing
under his hand and seal, one judge to hold the next
election for burgess and commissioners; and the said
judge shall conduct the said election in the same man-
ner in which the judges of an election district are now
by law directed to hold an election for delegates to the
