security to be approved by the court, or the judge there-
of, if in recess, to satisfy any judgment that shall be re-
covered in such case against the defendant or defen-
dants.

SEC. 5. And be it enacted, That so much of the
act passed at November session of the year seventeen
hundred and ninety-five, chapter fifty-six, entitled
a supplement to the act, entitled an act directing the
manner of suing out attachments in this province, and
limiting the extent of them, as relates to the citizen-
ships of plaintiff or defendant, or the defendants not
being a citizen of this State, (as the case may be,) and
also, so much thereof as requires any other averment in
the oath of the plaintiff, as to the fact of the defendant's
having absconded, than is set forth in the third section
of this act; and that the preamble and first section
of the act passed at December session of the year eigh-
teen hundred and twenty-five, chapter one hundred and
fourteen, entitled an additional supplement to the act,
entitled an act directing the manner of suing out at-
tachments in this province and limiting the extent of
them, and the first and second sections of the act passed
at December session of the year eighteen hundred and
thirty-four, chapter seventy-nine, entitled a further sup-
plement to the act entitled, an act directing the man-
ner of suing out attachments in this province and limit-
ing the extent of them, and the second and third sec-
tions of the act passed at December session of the
year eighteen hundred and thirty-nine, chapter thirty-
nine, entitled a further supplement to the act, entitled
an act directing the manner of suing out attachments in
this province and limiting the extent of them, be and
the same are hereby repealed.
