1852.

county and city, as provided for in the preceding sec-
tion, shall be unable to agree in opinion as to the divi-
sion of the property, then they are hereby authorised
and required, to select some person to act as arbiter,
who shall be a non-resident, and non-property holder

of the said city and county, and who shall examine the
whole proceedings of the commissioners to be appoint-
ed, to value and divide the property now held jointly
by the county and city of Baltimore, and shall make
a report of his views thereon, to the county commis-
sioners of Baltimore county, and to the Mayor and City
Council of Baltimore.

CHAP. 357.

SEC. 3. And be it enacted, That the persons ap-
pointed in pursuance of the provisions of this act, to
value and divide the property now jointly held by the
county and city of Baltimore, before they proceed to
act in the performance of their duties, shall severally
make oath or affirm as the case may be, faithfully and
impartially to perform all the duties imposed on them
by this act, and it shall also be the duty of the person
to be selected as arbiter, before he proceeds to act to
make oath or affirmation to the same effect.

SEC. 4. And be it enacted, That the commissioners
appointed to value and divide the property held jointly
by the county and city of Baltimore, are hereby autho-
rised to employ a clerk, by whom all the proceedings
had by them under this act, shall be recorded, and when
the duties of said commission shall have been fully
performed, it shall be the duty of the commissioners ap-
pointed to value and divide the property held jointly by
the county and city of Baltimore, to furnish a copy of
their proceedings in full, property attested to the county
commissioners of Baltimore county, and also a copy to
the Mayor of the city of Baltimore.

SEC. 5. And be it enacted, That it shall be the duty

of the county commissioners of Baltimore county, and

of the Mayor of the city of Baltimore, to furnish to
the General Assembly of Maryland, within the first ten
days of the session, to commence on the first Wednes-
day of January, eighteen hundred and fifty-three, full
copies of all proceedings had by the commissioners, to
value and divide the properly held jointly by the county
and city of Baltimore, and also of the report of the
arbiter, who may be appointed in virtue of the provi-
sions of this act.

SEC. 6. And be it enacted, That the commissioners

each receive four dollars for each and every day while
