1852.

laborer the amount so due him for such labor, and an
action may be maintained against said company therefor;
finch notice shall be given by said laborer to said com-
pany, within twenty days after the performance of the
number of days labor lor which the claim is made ;
such notice shall be in writing, and shall state the
amount and number of days labor, and the time when
the same was performed for which the claim is made,
and the name of the contractor from whom due, and
shall be signed by said laborer or his attorney, and shall
be served on an engineer, agent or superintendent em-
ployed by said company, having charge of the section

of the road on which such labor was performed, perso-
nally, or by leaving the same at the office or usual place

of business of such engineer, agent or superintendent, or
with some person of suitable age, but no action shall be
maintained against said company under the provisions of
this section, unless the same is commenced within thirty
days after notice is given to the company, by such
laborer as above provided.

CHAP. 326.

SEC. 12. And be it enacted, That the president
and directors shall have power to lay off and construct

a rail road, not exceeding eighty feet in width, with
one or more sets of tracks, from the city of Baltimore,
to some point on the Pennsylvania line, between Cono-
wingo creek, and Little Elk creek, crossing the Sus-
quehanna river, at or between Conowingo and Port
Deposit, so as to connect with a contemplated rail road
in the State of Pennsylvania, from Philadelphia to the,
Maryland line, and for the purpose of laying off and

constructing the said road, they shall have all the pow-
ers and privileges, and be subject to all the restrictions
and liabilities hereinafter described, and they may take
the route which, to them, may seem most suitable and
proper.

SEC. 13. And be it enacted, That the president
and directors of the said company, shall be, and they
are hereby invested with all the rights and powers ne-
cessary for the repairs of said rail road, and also, with
power to decide on as many lateral ways, to run from
the main stem of the rail road hereby intended, at some
suitable point or points thereof, to be by them deter-
mined, not exceeding eighty feet wide, with as many
sets of tracks as the said president and directors may
deem necessary, and they may cause to be made, or
contract with others for making said rail road, or any
part of it, or of said lateral rail roads, and they, their
agents, or those with whom they may contract for
making any, part of the same, or their agents, after
the purchase and condemnation thereof, in the manner
