CHAP. 318.

of the company shall not be assessed without the con-

sent of every member, nor shall the capital of the com-

pany be increased without the consent of the owners of
two-thirds of the whole number of shares; the president
and directors may with the consent of the owners of
two-thirds of the capital stock, sell or dispose of any
real estate, mines or mining rights of the company, or
buy other real estate, mines or mining rights or wind
up the affairs of the company; and distribute its assets
among its members.

Banking for-
bid.

SEC. 6. And be it enacted, That this act shall not
be construed, to confer on said corporation any banking
powers, or the right to issue any bill or note in form or
style of a bank note, and the Legislature reserves the
right to after, amend or repeal this act at pleasure.

AN ACT to Incorporate a Company to make a
Turnpike Road in Washington County, from Wil-
liamsport to the Pennsylvania Line, in the direc-

tion of Mercersburg, in Franklin County, Penn-

sylvania.

Incorporated.

SECTION 1. Be it enacted by the General Assembly

of Maryland, That a company be, and is hereby incor-
porated to make a turnpike road in Washington County,
from Williamsport to the Pennsylvania line, in the di-
rection of Mercersburg, Franklin county, Pennsylvania,
beginning at the northern limits of the town of Wil-
liamsport, and to be located on the most practicable
route, to be constructed of stone, gravel or plank, and to
be located, graded and constructed, under the direction

of the president and board of managers, to be chosen
under the provisions of this act.

Authority to
locate road.

SEC. 2. And be it enacted, That the said company
shall have the privilege, and are hereby authorised and
empowered to locale said road, over any bridge built by
said county, or over any road part or parts of road or
roads laid off by said county, as a public road if they
deem it proper so to do.

poration, &c.

SEC. 3. And be it enacted, That the stockholders
in said company shall be, and they are hereby incorpo-
rated and constituted a body politic, by the name and
style of the Williamsport and Mercersburg Turnpike
