or thing cognizable by him under the provisions of this
act, and he shall have full power and authority to enforce
the attendance of witnesses, by attachment directed to
the sheriff of Dorchester county, whose duty it is here-
by made to serve, the same under penally of not less
than five nor more than fifty dollars, to be imposed by
the Circuit court of said county, upon being satisfied
that his failure to do so has been wilful, and the said
commissioner, upon return of said attachment, shall re-
ceive the statement of the witness under oath, and such
testimony as shall appertain to his exculpation from,
or guilt of contempt, to be laid before the Orphans'
court, who may thereupon fine such party, if guilty, a
sum not exceeding twenty dollars.

CHAP. 316.

SEC. 17. And be it enacted, That it shall be the
duty of the sheriff of said county of Dorchester, to
obey and execute all processes and orders of the said
commissioner in like manner as he is now bound to
obey and execute the orders and processes issued out

of the Circuit court for Dorchester county, for the like
lees for the services aforesaid; and all witnesses attend-
ing before the said commissioner, shall receive the same
per diem fees they are entitled to receive when attending
before the Circuit court for said county.

Duty of
sheriff.

SEC. 18. And be it enacted, That the said commis-
sioner is hereby authorised to issue commissions to take
the testimony of witnesses residing beyond the limits

of said county of Dorchester, in any matter or issue
pending before him with like authority, and to be is-
sued, executed and returned, in the same manner as is
now provided by law for the issuing, execution and re-
turn of commissions to lake testimony from the Cir-
cuit court of said county, beyond the limits of this
State.

SEC. 10. And be it enacted, That the said commis-
sioner shall have power to appoint his own clerk, whose
duty it shall be to keep a fair record in a proper book
to be provided at the county charge, of all matters and
proceedings before the said commissioner, and to make
fair and legible copies of all the testimony taken before
him, and such other duties as shall be prescribed by
said commissioner, and said clerk shall receive a salary
to be paid to him by the commissioners of Dorchester
county.

SEC. 20. And be it enacted, That Daniel M. Henry,

of Dorchester county, be, and he is hereby appoint-
ed commissioner to carry into execution the provi-
sions of this act, and shall hold his appointment for the
