1852.

from the place where the rail road shall cross any such
road or street, and be sounded at intervals until it shall
have crossed such road or street, under the penalty of
thirty dollars for the neglect of the provisions of this
section, to be sued for before any justice of the peace

of the election district or ward in which such neglect
may happen, in ten days after such penalty was incur-
red, one half thereof to go to the informer, and the
other half to the county or city in which such neglect
may happen; and said company shall also be liable
for all damages which shall be sustained by any person
by reason of such neglect; and all penalties imposed
by this act may be sued for in the name of the State,
and if such penalty shall be for a sum not exceeding
one hundred dollars, then such suit may be brought be-
fore a justice of the peace, and may be commenced by-
serving a summons on any director, agent or engineer

of said company.

CHAP. 304.

SEC. 26. And be it enacted, That if this road shall
not be commenced in three years from the passage of
this act, and shall not be finished in ten years from the
time of the commencement thereof, then this act shall
be null and void.

SEC. 27. And be it enacted, That full power, right
and privilege is hereby granted and reserved to the ci-
tizens of this State, or any company hereafter to be in-
corporated under the authority of this State, to connect
with the railroad hereby provided for, any other rail
road leading from the main route to any part or parts of

this State; Provided, that in forming such connexion
no injury shall be done to the works of the company
hereby incorporated.

Proviso.

SEC. 28. And be it enacted, That if any person
or persons shall ride, drive or lead any animal or ani-
mals, or shall drive or ride in any carriage, wagon, or
other article, except in the cars or service of said rail
road, or by the written permission of said company,
except at or upon the crossing places upon said road,
shall be liable, each and every of them, to a fine of
five dollars for each and every offence, to be recovered
before any justice of the peace in the county in which
the offence is committed, as small debts are by law re-
coverable; and that any process that shall be issued,
shall be only on the complaint of said company, to

sued, may remit in whole or in part any fine that may
have been previously adjudged.
