1852.

vided, the flame is published with the rules and regula-
tions of the company; and the said road or roads, with
all their works, improvements and profits, and all the
machinery of transportation used on said road, are here-
by invested in the said company incorporated by this
act, and their successors forever, and the shores of the
capital stock of the said company, shall be deemed
and considered personal estate, and shall be exempt
from the impositions of any tax or burthen.

CHAP. 304.

Sue. 19. And be it enacted, That the president and
directors, or a majority of them, shall annually, or
semi annually, declare and make such dividends as
they may deem proper of the net profits arising from
the resources of said company, after deducting the ne-
cessary current and probable contingent expenses, and
dim they shall divide the same amongst the stockhold-
ers of said company, in proper proportions to their re-
spective shares.

SEC. 20. And be it enacted, That the president and
directors of the said company, or a majority of them,
be, and they are hereby authorised, if they shall deem
it expedient, to cause subscription books to be opened
in Hagerstown and Williamsport, under the direction

of such commissioners as they may select, for the pur-
pose of raising such additional amount of capital as
they in their discretion may consider necessary for ex-
tending the said road to Hagerstown, in Washington
county, and from thence to Williamsport on the Poto-
mac river.

SEC. 21. And be it enacted, That if the said com-
pany shall not be able to contract with the Baltimore
and Susquehanna Rail Road company, for intersecting
their said road, that then, and in that event, nothing
herein contained shall be so construed as to authorise
said company to locate, extend, or make the said Rail
Road, or any part of it, within the city of Baltimore,
without the consent, of the mayor and city council of
Baltimore first had and obtained.

SEC. 22. And be it enacted, That if any person or
persons shall wilfully, by any means whatsoever, injure,
impair, or destroy any part of any rail road constructed
by said company under this act, or any of their neces-
sary works, buildings, locomotives, curs, or other ma-
chinery of said company, such person or persons so of-
fending, shall, each of them, for every such offence,
forfeit and pay to the said company, a sum not exceed-
ing five hundred dollars, which may be recovered in
the name of the said company, by an action of debt in
the Circuit Court of the county wherein the offence
