the provisions of this act, be and the same are hereby
repealed.

An act entitled, an act relative to the tax imposed by
the act of eighteen hundred and forty-one, chapter
three hundred and twenty-five.

Proof of non-
payment to ex-
empt collector.
|
Be it enacted by the General Assembly of Maryland,
That from and after the passage of this act, in any
suit instituted, or that may be hereafter instituted in
this State, against any collector of tax, or his surety
or sureties, for the recovery of the tax imposed by the
act passed December Session, eighteen hundred and
forty-one, chapter three hundred and twenty-five, the
said collector, or his surety or sureties, shall not be
liable in said suit for such amount of said tax as shall
be proved by him or them, not to have been collected
or received by said collector.

An act relating to a Devise.
|

1850.
Preamble.
|
WHEREAS, doubts exist in the mind of the surviving
trustee hereinafter referred to, as to his power to execute
a lease or leases for the ground devised to him and his
late co-trustee, now deceased, by George Warner, late of
Baltimore, deceased, by his will, duly proven and record-
ed, in trust for Mrs. Dorothea Miltenberger dining her
natural life, to her sole and separate use, and after her
decease, in trust, for the children of the said Dorothea, as
set forth in said will, and in the event of the said Doro-
thea dying without children, then for such further uses
as are declared in said will, except in a lot or lots of
ground fronting on the street and running back to the
alley or alleys referred to in said will of George Warner,
deceased as aforesaid; and whereas, it is represented to
this General Assembly, that it will be for the advantage
of the cestuique trusts above referred to that the surviv-
