1849.

it is further enacted, that the sheriff and each of the
jurors, who shall be summoned as hereinbefore autho-
rised, shall receive from the said commissioners the
sum of two dollars for each day they may be actually
engaged in making condemnation of lands as afore-

said; provided however, that nothing contained in this

act shall be so construed as to prevent the right of
appeal to the county courts of Carroll and Frederick
counties; appeal to be taken in the county where the
land lies.

Proviso.

SEC. 7. And be it enacted, That so soon as five
miles of said road shall be completed, it shall be the
duly of the said commissioners to report the same to the
Governor, for the time being, of this State, who shall
thereupon be authorised to issue under his hand and the
seal of the State, a license to said commissioners to erect
a toll gate; and in like manner to report to the Governor
upon the completion of each succeeding five miles, and
to receive a similar license for the erection of toll gates
upon such subsequent completion of five miles of said
road.

SEC. 8. And be it enacted, That the said commission-
ers before the election of the president and directors as
hereinbefore provided, and the said president and direc-
tors after they shall be appointed as hereinbefore desig-
nated, shall have power to appoint keepers of said toll
gates, and shall be authorised to charge toll for all travel,
and so forth, over said road, at a rate not to exceed that
which is authorised by an act passed at November ses-
sion, eighteen hundred and four, chapter, fifty-one, en-
titled, an act to incorporate companies to make several
turnpike roads through Baltimore county, and for other
purposes, and that the said commissioners and president
and directors, shall be generally invested with all the privi-
leges not inconsistent with the provisions of this act of
eighteen hundred and four, chapter fifty-one, conferred
upon the companies thereby incorporated.

SEC. 9. And be it enacted, That that the said com-
missioners be and they are hereby authorised and em-
powered to make the said road or any part thereof, with
plank instead of stone, if in their judgment it shall be
better so to do.

SEC. 10. And be it enacted, That all tolls received
for travel, and so forth, over said road after the same
shall be completed, which shall not be required for the
repairs of said road and the payment of the necessary
expenses thereof, shall be from time divided amongst
the said stockholders in such manner as the president
