LAWS OF MARYLAND.

CHAP. 196.

rights, powers and privileges vested in the company
hereby incorporated, or in the said managers, or for
the performance of the duties required of them by this
act, and the said bye-laws, from time to time, to alter
and repeal, subject, nevertheless, to the supervision of
the stockholders at a general meeting, as is hereinbe-
fore provided.

Powers, &c.

SEC. 8. And be it enacted, That the said company
is hereby invested with all the rights and powers ne-
cessary to the construction of a plank or turnpike
road on the bed of said county road, as far as may be
advisable to use it, thence along the margin of

Gwinn's Falls to the Liberty road; provided, that lay-
ing out and constructing the said plank or turnpike
road, the said company shall not obstruct, or in any
manner injure any other plank, or turnpike, or coun-
ty road, or impede the traveling on, or using any part
of such plank, or turnpike, or county road, or any pri-
vate road, which any person or persons is or may be
entitled to travel on or use.

how paid in.

Sec. 9. And be it enacted, That after thirty days
public notice, in public papers as aforesaid, of the time
and place appointed for the payment of any instal-
ments for the capital stock of said company, if any
stockholder shall neglect to pay such instalment at
the place appointed for the space of thirty days after
the time so appointed, every such stockholder, his, her
or their assigns, may be required in addition to the
payment so called for, to pay at the rate of one per
cent per month, for delay of such payment, and if the
same, and the said additional penalty, shall remain un-
paid for such space of time as that the accumulated
penalties shall become equal to the sums before paid,
in part, on such account of such share or shares, the
same shall be forfeited to the said company, and may
be sold and assigned by the president and managers
of said company, to any person willing to purchase
the same, for such price as can be obtained for the
game, and the purchaser or purchasers aforesaid, shall
have all the benefit and advantage of such assign-
ment and purchase, as if he, she or they had been an
original stockholder, or the managers may, at their
option, enforce payment of any instalment, by war-
rant or action, as the case may require.

SEC. 10. And be it enacted, That the said plank or
turnpike road be made in, over and upon the bed of
the present county road as laid out, and used, and on
the margin of the west side of Gwinn's Falls; provi-
ded always, that should it appear on a resurvey of any
