1849.

SEC. 3. And be it enacted, That should either of
the said commissioners refuse, or become in any way
unable to act, the commissioners of the tax for Carroll

county, or the commissioners of Baltimore county, as
the case may be, on proper application to be made by
some parly interested in said road, shall appoint some
other suitable person to act as his successor, who shall be
clothed with all the powers hereby given to any of the
first, named commissioners.

CHAP. 181

Vacancies—
how supplied.

SEC. 4. And be it enacted, That the said road com-

missioners or a majority of them, shall value and assess
the damages to be sustained by any person over whose
land the proposed road shall pass, taking into considera-
tion the advantages or disadvantages of the said road to
them, and as soon as may be, after the laying old and
locating said road, they shall report over their own
hands to the commissioners of the tax for Carroll coun-
ty, and also to the commissioners of Baltimore county,
all their proceedings in the premises, which said reports
shall state particularly the amount of damages awarded
to the owners of the land as aforesaid, the expense of
surveying, laying out and locating said road, and so
forth, each report to be accompanied by a plat of said
road, and to be recorded by the commissioners of the
said counties, respectively.

Damages, etc.

SEC. 5. And be it enacted, That the said read com-
missioners shall be entitled to receive two dollars per
day each, whilst they are necessarily employed in ex-
ecuting the duties aforesaid, and that the expenses in-
curred for surveying, laying out, and locating the said
road shall be levied for, collected and paid to the said
road commissioners, by the commissioners of the said
counties respectively, in the same manner as other
charges of said counties are levied for, collected, and
paid, that is to say, in proportion to the distance the
said road shall pass through each of the said counties,
respectively.

Compensation.

SEC. 6. And be it enacted That all other expenses
incurred as aforesaid or otherwise, relative to the said
road, either for damages assessed or for opening said road,
shall be paid by the petitioners of the said coun-
ties respectively, to the parties entitled thereto, in
the proportion provided for in the fifth section of this
act, and after said road shall have been opened and
made passable, the same shall be kept in repair as other
public roads in the said counties, respectively are.
