LAWS OF MARYLAND.

CHAP. 220.

said justice shall certify and send a copy of said inquisi-
tion to the judges of said court, and said court shall

thereupon order capias ad respondendum against said
president, to which the name of the attorney general
or his deputy for the county shall be put, and the same
proceedings shall be had in said action as in other like
suits at law, and if it shall appear that the neglect
charged in said inquisition is well founded the said
court shall give judgment according to the nature and
aggravation of the neglect, and shall proceed to fine
said president and company in any sum not exceeding
two hundred dollars.

Stock trans-
ferrable.

SEC. 15. And be it enacted, That it shall and may
be lawful for every of the said stockholders or proprie-
tors to transfer his or her share or shares, by such deed

and in such form as the said president and directors
by bye law or rule shall direct, and if any person shall
die intestate holding any share or shares of said stock,
the administrator or administratrix or administrators of
said intestate shall hold the same interest in said stock
and be entitled to all the benefits thereof, including the
power to vote for officers of said company, as the said
intestate shall have held in his lifetime thereto, and
shall be and hereby are authorised and empowered to
transfer the same or make sale thereof in his, her of
their own name or names, and the same shall be sub-
ject to the same distribution or disposition as other
personal property of said intestate.

SEC. 16. And be it enacted, That so soon as the
said company shall have finished or perfected said road
for any distance not less than five miles, commencing at
Frederick, and so from time to time buy other like dis-
tance progressively, the president of said company shall

give notice thereof to the governor of this state, who-
shall thereupon appoint three skillful and judicious per-
sons to examine the same and report to Him in writing,
whether said road is constructed in a masterly, work-
manlike manner, according to the true intent and
meaning of this act, and if their report shall be in the
affirmative, then the governor shall by license, under
the seal of the State, permit and authorise said presi-
dent and directors to erect and fix such and so many
toll gates across the said road as will be necessary to
collect the tolls or duties herein granted to said com-
pany.
