1847.

any three of the directors may call special meetings of
the board, at such time and place as they may think
necessary.
SEC. 5. And be it enacted,That it shall and may
be lawful , to and for the said president and directors

and those who may be in their employment for that
purpose to enter into and upon all and every the lands,
tenements and enclosures, in, through and over which the
said road may be by them intended to pass, to examine
the ground most proper for the purposes, and the
quarries and beds of stone, and gravel, and other ma-

terials that, will, be necessary in constructing said

road, its bridges and culverts, and to survey, lay down
mark, and fix such route and track for, the same as in

the best of their judgment and skill will combine
shortness of distance, with the best and most practica-
ble ground from Frederick to Leitersburg aforesaid,
provided, that said road shall not be carried through
any building, garden, orchard or yards without the
consent of the owner and possessor thereof.

CHAP. 220.

Proviso.

SEC. 6. And be it enacted, That said president and
directors shall cause said road to be laid out at least
forty-eight feet wide, and have ditches cut on each
side thereof, and throw up and ridge the said road
so that the water may be thrown off both sides from
the centre, and shall open drains, make and construct
culverts and bridges over the creeks or water courses
said road may cross whenever the same may be requi-
ed for the safely and convenience of travellers, and
said road shall be made with an even surface as far
as can be done, and so nearly level, in its progress as

that it shall in no place, rise or fall more than will form
an angle of four degrees with, an horizontal line, ex-
cept in its passage over the mountains, where said road

shall be made so nearly, level in its progress as that,
it shall in no place upon said mountains rise or fall
more than will form an angle of five degrees with an
horizontal line, and they shall forever thereafter main-
tain and keep the said road in good order and

repair.

SEC. 7. And be it enacted, That said president and

directors and their successors, or a majority of a quorum
of them when assembled, shall have full power and
authority from time to time to agree with and employ
any person or persons on behalf of said company to
make and construct said road, bridges, ditches and cul-
verts in the manner heretofore directed, and to all other
things for the completion and repair of said road in-
