CHAP. 201.

the name of the State, to recover whatever may be thus
ascertained to be due.

Compensation
— how paid.

SEC. 8. And be it enacted, That Allegany county
court shall allow whatever compensation they shall
deem right and proper to the said auditors for investiga-
ting said accounts and the necessary expenses incurred
in said investigation, and such compensation to coun-
sel employed in conducting said suit or suits as the said
court shall deem right and proper, to be paid put of the
revenues of the said road.

intendent.

SEC. 4. And be it enacted, That all unpaid accounts
against the said road shall be presented to the said
auditors, properly authenticated, and be by them passed
if they shall be satisfied of their validity, before the
same shall paid by the superintendent or other represen-
tative of the road.

Superinten-
dent to pay &c.

SEC. 5. And be it enacted, That it shall and may
be lawful for the superintendent or any other person or
persons having the management or control of the affairs
of said road, from and after the passage of this act to set
apart and pay over to persons having claims against the
said, road passed by the auditors aforesaid twenty-five
per centum of the gross receipts of all the tolls there-
after received on said road, which payments shall be
made in monthly instalments commencing on the fif-
teenth day of April eighteen hundred and forty-eight,
and divided amongst said creditors in proportion to the
amount of their respective claims.

Suit may be
brought on the
bond of the
superintendent

Proviso.

SEC. 6. And be it enacted, That it shall and may
be lawful, after the passage of this act, for all persons
haying claims against that part of the United States
road lying within the limits of and belonging to, this
State, either for work done or materials furnished, and
which said claim or claims have been due and unpaid
for the space of twenty days, to bring suit on the bond
of said superintendent or other representative of said
road appointed or elected to receive and disburse the
monies belonging to said road in such manner as suits
are now brought on constables and sheriffs bonds in this
State; provided, that in all cases suits shall be brought
on the bond of the superintendent or other representa-
tive of said road as aforesaid with whom such contract
or contracts were made.

When claim is

below $100.

SEC. 7. And be it enacted, That when the claim, or
demand against said road does not exceed one hundred
dollars, it shall and may be lawful to warrant on the
bond or bonds of said superintendent or other represen-
tative of said road for the same, before any justice of
