manner with any other school receiving a donation from
the State, and that the same shall he kept separate and
distinct.

CHAP. 100.

SEC. 5. And be it enacted, That it shall be the duty
of the leaders of said schools to attend at the school-
house, in which they may he employed to teach, at least
ten months in each and every year, exclusive of all vaca-
tions, unless prevented by sickness or other unavoidable
circumstances, otherwise a deduction shall be made for
all loss time, in ratio to the salary allowed by this act,
and it shall he the duty of each teacher of said schools
in said county, to make an affidavit, at the expiration of
each year, of the time by him taught, and the average
number of scholars which have attended his school dur-
ing said year, which affidavit shall accompany the annual
report of the trustees of said school.

SEC. 6. And be it enacted, That whenever it may ap-
pear to the orphans court of said county, that the aver-
age number of scholars taught in any of said primary
schools in any one year has not exceeded ten, said schools
shall not be entitled to more than one hundred and fifty

dollars annually.

SEC. 7. And be it enacted, That, in order to enable
the orphans court of said county to apportion the several
sums which may be due to said primary schools, accord-
ing to the provisions of this act, it shall be the duty of
the trustees of all such primary schools as shall have
been in operation, to make their annual reports in regard
to said schools to the orphans court of said county on or
before the first day of January, in each and every year
but in case the orphans court shall be of opinion, on the
first day of January, as above specified, that all the an-
nual reports in regard to such schools as had been in
actual operation the preceding year, had not been pre-
sented to said court, then and in that case the said court
may extend the time for the distribution of the school
fund among such primary schools as shall have reported
according to the provisions of this act, to a period not
exceeding fifteen days longer.

SEC. 8. And be it enacted, That when the trustees of

said primary schools shall have complied with the requi-
sitions of the original act, and the several supplements
thereto, together with the provisions of this act, and, shall
have reported accordingly to the orphans court of said
county, the said court is hereby authorised and required,
on the first day of January, or as soon thereafter as said
court may deem expedient, not exceeding the fifteenth
