CHAP. 151.

in strict conformity to the provisions of the laws in force
in this State, in regard to the execution, acknowledgment
and recording of deeds for the conveyance of real estate,
and that the same he recorded in one of the land record

books of said county.

CHAPTER 151.

27, 1847.

An act to lay out and open a Road through a part of Fre-
derick and Montgomery Counties.

Authorised to
appoint three
commissioners.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the levy court of Frederick county, and
the commissioners for Montgomery county, are hereby
authorised and empowered, it in their opinion it be expe-
dient and promotive of the public convenience to appoint
three commissioners; the levy court of Frederick county
to appoint one, and the commissioners for Montgomery
county the other two, to have, or cause to have surveyed
and opened a road commencing on the south side of

Survey and
open a road.

Sheckel's branch, where it crosses the road leading from
Damascus to Clarksburg, in Montgomery county, and
running from thence, the most convenient and advantage-
ous route to cross Bennet's creek, at the present ford near
John Boyer's mill, thence to Bethesda church, and
thence to intersect the road leading from Hyattstown to
Newmarket, at or near the ford where Bennet's creek
crosses said road in Frederick county near Eli Davis' mill.

Expenses of
surveying and
opening road
—how paid.

SEC. 2. And be it enacted, That the expense of sur-
veying and opening the said road, shall he paid by the
aforesaid counties according to the expense incurred in
each county, and the levy court of Frederick, and com-
missioners for Montgomery county, are hereby authoris-
ed to levy on the assessable property of said counties the
sum necessary to defray the expense of surveying and
opening said road in each county, to he collected as other
county charges are, and the said road when so opened
shall be kept in repair as other public roads are.

SEC. 3. And be it enacted, That the road commis-
sioners, or a majority of them, shall value and ascertain
the damages that may be sustained by any person or per-
sons through whole land the said road may pass, taking
into consideration the advantages and disadvantages, if
any, and the said damages to be levied, assessed, col-
lected and paid over by the proper authorities of said
counties to those who may be entitled to the same.
