USURY—In

any suit brought in any court, etc. upon

any bond, etc. in which any person shall

seek to avail himself, etc. of the provisions

of the act of 1704, against excessive usu-

ry, it is incumbent on such person special-

ly to plead the same, and to state in said

plea and set out the sums, etc. actually due

upon such bond, etc. estimating the prin-

cipal with interest at 6 per cent.

Upon the trial of any issues upon such

pleas, jury to ascertain the amount, etc.

and to render verdict, upon such verdict,

court to render judgment, etc.

etc, chancellor or judges, etc. to ascertain

If at time of pleading, or upon the trial,

etc. defendant tender to plaintiff the suras

alleged to be due and costs up to the time

the jurors, etc. it appeal that the sums ac-

tually due, etc. did not exceed in principal

and interest and costs, at the time of plea,

the sum tendered, then the plaintiff shall

be adjudged to pay costs accruing after

tender.
