SHERIFFS—

such writ may he directed, shall proceed,

and return the same as provided by act of

1813, ch. 201, and if it appear that the

process returned by executor, &c. of de-

ceased sheriff, &c. was wholly unexecuted

at the time of his death, plaintiff to be en-

titled to an alias writ as provided by act of

1842, ch. 272, &c.

In all cases where any sheriff, &c. shall

die, having; in his hands at the time of his

death any writ of ca. sa. and said writ re-

turned cepi without further proceedings,

SLAVES—

If any slave convicted of the crime of murder

in second degree or accessory thereto, or

of manslaughter or rape, or accessory be-

fore the fact, or of carnally knowing a wo-

man child, when under 10 years of age, or

of assault with intent to murder, rob or

commit rape, &c. or of conspiring, &c. to

raise insurrection, &c. or of burglary, &c.

or of arson, &c. such slave to be punished

as all other persons now are for like of-

fences, etc.

In all cases where convicted, &c. the

punishment of which to be imprisonment

in the penitentiary, and such slave shall

be sentenced by the court to confinement

in the penitentiary, the court to value said

slave, valuation to be certified to, by levy

court, &c. of the county, &c. who are to

levy the amount of such valuation payable

to the order of master, &c.

For reimbursing said county for the

value of such slave so paid for, the keeper

or warden of penitentiary, at expiration

of service of such slave, to sell at public
