CHAP. 340.

measurement of lime of any one inspector or measurer,
and that the board of appeals should determine, contra-
ry to the judgment of the inspector and measurer every
time, upon application to the Governor of the State, he
may at his discretion dismiss such inspector and measurer,
and appoint another in his place.

Repealed.

SEC. 5. And be it enacted, That the second section of
an act passed at December session, eighteen hundred and
thirty-five, chapter seventy-six, and entitled, an act to
alter and amend an act providing for the appointment of
lime inspectors for the city of Baltimore, and prescribing
their duties, be and the same is hereby repealed.

Preamble.

An act respecting the punishment of Slaves.

WHEREAS, in the opinion of this General Assembly,
transportation or banishment is no adequate punishment
for the higher grades of offences which may be commit-
ted by slaves within this State, and for which said, pun-
ishment is now provided by law — therefore,

Slaves to be
punished, &c.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That from and after the passage of this act,
if any slave or slaves shall be convicted of the crime of
murder in the second degree, or as accessary thereto, or
of manslaughter, or of rape, or as accessary thereto be-
fore the fact, or of carnally knowing a woman, child un-
der the age of ten years, or of an assault with the intent
to rob, murder or to commit a rape, or of robbing or as
accessary thereto before the fact, or of consulting, con-
spiring, or attempting to raise insurrection or rebellion
in this State, or of burglary, or as accessary thereto be-
fore the fact, or of arson or as accessary thereto, such
slave or slaves shall be punished in the same manner, and
with the like punishment, as all other persons are now
punished for the like offences, any law to the contrary
thereof notwithstanding.

Court to value.

SEC. 2. And be it enacted, That in all cases where any
slave or slaves shall be convicted of any of the aforesaid
crimes, the punishment of which shall be confinement in
the penitentiary, and such slave or slaves shall be sen-
tenced by the court to confinement in the penitentiary,
it shall be the duty of the said court to value the said
