SEC. 9. And be it enacted, That this act of incorpo-
ration shall enure for thirty years; and that the legis-
lature hereby reserves to itself the right to alter and an-
nul this act of incorporation at pleasure.

An act for the relief of John L. Hook and others, devisees
of James Hook, late of Allegany County, deceased.

Passed Feb.
16, 1846.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That it shall and may be lawful for Allegany
county court, sitting as a court of equity, in the suit now
pending in said court, in which John L. Hook, James S.
Hook, Isaac S. Hook, Thomas D. Davis and Matilda
Jane Davis, his wife, and Kizia Hook, widow, are com-
plainants, and Kizia E. Davis, James R. Davis and John
E. Davis, infants and defendants, to order and decree a
partition of the real estate of James Hook, late of Alle-
gany county, deceased, among the said parties, accord-
ing to the course and practice of the courts of equity of
this State, notwithstanding some of the persons or par-
ties who may he ultimately entitled in remainder as chil-
dren of the said Matilda Jane Davis, under the will of
the said James Hook, may not be in esse, and the parti-
tion shall he as effectual a title to the parties respective-
ly, according to the said partition, as if all the said par-
ties in interest, were now in esse, and were regularly
made parlies to the said suit, and the said court may or-
der and direct, such amendments in, or modifications of
the said bill, or other proceedings, as it may deem ne-
cessary or proper to carry into effect the provisions of
this act.

SEC. 2. And be it enacted, That the said court may,
and it is hereby authorised, to appoint a trustee for the
said Matilda Jane Davis, to hold the portion of said es-
late, which in the said partition, may be allotted to her
and her children, and to pay to her during her life, an-
nually or oftener, the rents, issues and profits thereof, in
the same manner as the trustees appointed by the said
will, were required by the same to do.
