LAWS OF MARYLAND.

CHAP. 200.

sum of one hundred thousand dollars, to be approved by
the Treasurer of said State, for the faithful payment of
all prizes that shall be drawn in such lottery or lotteries,
as the same shall become payable and be legally de-
manded.

Bonds may be
sued on.

SEC. 4. And be it enacted, That the bond or bonds,
required to be given by the second and third sections of
this act, may be sued upon in the name of the State of
Maryland, by any person or persons interested in the
same.

Contractors

appointed, to
pay 5 per cent
on sales of
tickets.

SEC. 6. And be it enacted, That the contractors ap-
pointed by the managers and conductors of lotteries
aforesaid, for the vending and retailing of tickets and
shares of tickets, must pay to the State of Maryland, in
the place of a license, five per centum on the amount of
their sales of tickets, at scheme price; and it is hereby
provided, that the managers and conductors of lotteries
collect the tax aforesaid, and make a quarterly return to
the Treasurer of the State of Maryland, on oath, of all
such amounts so collected.

Commission-
ers to approve
of schemes.

SEC. C. And be it enacted, That the lottery commis-
sioners of the State of Maryland, be and they are hereby
authorised and requited to approve of such scheme, or
schemes of lotteries, from time to tune, as may be propo-
sed by the managers and conductors of lotteries, till the
amount of money shall have been raised, as named in the
first section of this act.

Allow com-
pensation.

SEC. 7. And be it enacted, That the commissioners ap-
pointed by virtue of this act, shall have full power to al-
low such compensation to the persons appointed to locate
said road, and for other necessary services by them, as
may in their judgment appear to be reasonable and just.

Fill vacancy.

SEC. 8. And be it enacted, That it shall be lawful for the
resident and surviving commissioners appointed by this
act, to supply, by the vote of a majority of them, any va-
cancy or vacancies which may occur in the board of said
commissioners, by the death, resignation, removal or re-
fusal to serve, of any commissioner appointed aforesaid,
for the drawing of said lottery, or performing any office
or duty imposed by this act.

Receive sub-
scriptions.

SEC. 9. And be it enacted, That the commissioners
named in this act, shall have power to receive subscrip-
tions for the purpose, of making said turnpike road, and
that after making part of said road between Westminster
and Taneytown, which shall be completed first, they
