INFANTS.—Where infants entitled to any legacy, &c.

of personal property, in hands of any exe-

cutor, &c. in this State, and such infants

under age and not residing in the State,

nor having any guardian therein, but resi-

ding in some other State, and having there

a guardian, &c, orphan's court of the

county in which said executor may have

administered in this State, upon petition

of such guardian, setting forth the premis-

es, and stating entire amount of personal

property, &c; and orphan's court being

satisfied of the truth of the facts, &c. may

order and direct said executor, &c. to trans-

fer legacy, &c. On failure of executor to

comply, &c. same proceedings to be had

against executor, &c. as is now provided

for by law for payment of legacies, &c.

giving such order, &c, to require guardian

to execute bond,&c. in double the amount

of such legacy, &c.
