CHAP. 270.

under said mortgage, and under and upon said judge-
ment or judgements, not inconsistent with the provisions
of this act, may be saved and reserved as against said com-
pany, and as against all other creditors of said company,
except this State.

SEC. 4. And. be it enacted, That if in the opinion of the
Attorney General it shall be necessary for the full protec-
tion of the rights of this State, that the mortgage men-
tioned in the preceding section, and the judgment or judg-
ments growing out of or based upon it, shall be assigned and
transferred to this State, for the purposes and to the ex-
tent contemplated by this act, then, and in that case, the
said mortgages, or such of them as have an interest there-
in, or their legal representatives, shall execute to this
State such further deed or instrument of writing, as the
Attorney General may approve, and as shall in his judg-
ment be sufficient to give to this State the legal control
over the said mortgage, and judgment or judgments grow-
ing out of or based upon said mortgage, for the purpose
aforesaid; such further deed or instrument of writing to
be recorded in the counties of York and Lancaster, in
Pennsylvania; copies whereof shall, under the seals of the
proper officers of said counties, be transmitted to the
Treasurer of this State.

 

CHAPTER 270.

1, 1845.

An act to abolish the office of Commissioners of the Tax for
Frederick County, and for other purposes.

Abolished

Section 1. Be if. enacted by the General Assembly of
Maryland, That all the powers and duties heretofore vest-
ed in the commissioners of the tax for Frederick county,
be and the same are hereby repealed, and that the office
of commissioners of tax for said county, and also the of-
fice of clerk to said commissioners be and the same are
hereby abolished, and that all powers and duties hereto-
fore possessed, and exercised by said commissioners of
the tax, be and the same are hereby vested in the justices
of the levy court of said county, and their successors in
office.

SEC. 2. And be it enacted, That the clerk of Frederick
county, be and he is hereby declared to be ex-officio clerk
of the levy court of Frederick county.
