CHAP. 233,

May purchase
and hold lauds
and real estate

SEC. 10. And be it enacted, That the said corporation
may purchase and hold in fee simple or otherwise, all such
lands and real estate suitable for the erection of the neces-
sary works, and that may be necessary in whole or in part
for the proper accomplishment of their undertaking, as
shall be proper, and may divert from the usual bed and
course for the purpose aforesaid, at such place or places as
they shall think lit and suitable for the purpose, any stream
or streams which they may think suitable or any part or
parts thereof, and the said corporation shall have full power
and authority to make conduits, pipes, sluices, schutes,
and use the water aforesaid, in said conduits, pipes, sluices,
schutes, or other machinery in such quantities as necessary
to force and carry stone, coal, &c, and shall have power
to make all necessary spouts, and collect streams of water,

and make dams wherever needed for the purposes of
forcing and carrying coal, or any other material through
said spouts, sluices, &c, from any point or points in the
Frostburg district, Allegany county, to the town of Cum-
berland, and the said corporation shall have power to ap-
propriate and use all water necessary to and for any ma-
chinery or improvement, which may be projected to carry
or force coal through any such improvement, and shall have
power to divert from the usual bed or course, any tributary
stream to Braddock's run, or any stream in the Frost-
burg or Cumberland districts, and shall have power to
make said pipes, sluices, schutes, conduits, &c, for the
conveyance of said coal and water over and along any

public highway, and the works, to renew and repair
from time to time; provided, the same does not in-
terfere with the public travel, and the said corporation
shall have power to make said conduits, pipes, sluices, and
schutes, to any point between said Frostburg district and
the town of Cumberland, and from time to time, extend
said improvement and its works, until the same reached
the said town of Cumberland, or any point within the said
town in the discretion of said company.

To construct

SEC. 11. And be it enacted, That the said corporation
shall have full power and authority to construct reservoirs,
and establish fountains in such parts of said works as they
may think proper, along the line of said improvements

SEC. 12. And be it enacted, That the president and
directors of the said company, may construct and repair
said works, according to the determination of the said
president and directors, and that they may contract for
making of the said work or any of the machinery, and may
with their agents enter upon, use and excavate, any land
they may need for the said works, or the erection of build-
ings necessary to said improvement, and may build bridges,
