comply with such order, his bond may be put in suit, and
he may also be attached for contempt, and fined not ex-
ceeding three hundred dollars.

CHAP. 202.

SEC. 2. And be it further enacted, That if any citizen
of, or resident in this State, shall be prospectively entitled
to any remainder, reversion or executory, devise in any
such legacy or bequest, upon the determination of the es-
tate or interest of such infant therein, it shall be lawful
for the said Orphans' court, in its discretion, before giv-
ing such order or direction as herein before provided, to
require that such guardian or some other person or per-
sons shall execute a bond to the State of Maryland in
double the amount or value of such legacy or bequest with
a surety or sureties, to be approved by said court, condi-
tioned that the said legacy or bequest, shall at the deter-
mination of the estate or interest of such infant therein,
be forthcoming in the county where such bond is taken,
for the benefit of the person or persons who may then be
entitled to such remainder, reversion or executory devise,
which bond shall be recorded in the office of the register
of wills of the said county, and any person interested in
said remainder, reversion or devise, shall be entitled to a
copy of said bond, and a certificate from the register un-
der his hand and the seal of his office, upon which copy
and certificate, an action may be maintained in the name
of the State, for the use of the party interested, and judg-
ment may be recovered upon such action for the damage
actually sustained.

CHAPTER 202

 

A supplement to an act passed at December session, eigh-
teen hundred and forty-one, chapter one hundred and
eighty-two, entitled an act to provide for the election of
the Commissioners of Montgomery County by the people.

Passed March
6, 1845.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That on the first Wednesday in October, in
the year of our Lord, one thousand eight hundred and for-
ty-six, and on the first Wednesday of October, in every
second year thereafter, the persons qualified to vote for
delegates to the General Assembly in Montgomery coun-
ty, shall, at the time and places of holding elections in
said county, vote by ballot for five persons as commis-
sioners for Montgomery county, no two of whom shall
