the Treasurer of this State, to be by him preserved, and
copies whereof shall be evidence in suits upon the bonds
of the register signing the same.
SEC. 6 And be it enacted, That the several Orphan's
courts of this State, in fixing the commissions of executors
and administrators, shall make no allowance for the tax
hereby imposed, it being the intention of this act that said
tax shall be borne by and paid out of such commissions,
and not by the estates of the deceased.

SEC. 6. And be it enacted, That it shall be the duty of
every executor or executors, administrator or administra-
tors, to whom letters testamentary or of administration
shall be granted, in addition to the oath or affirmation now-
required by law, to take an additional oath or affirmation,
that he, she or they will diligently and faithfully regard
and well and truly comply with the provisions of this act;
which oath or affirmation the respective registers of wills
are hereby required to administer, and to place the same
on record, with the usual oath or affirmation.

CHAPTER 185.

 

A further supplement to the act entitled, an act to Prevent
the Destruction of Oysters in the Waters of this State,
passed December session, eighteen hundred and thirty-
three, chapter two hundred and fifty-four.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the provisions of the act supplementary
to the act to which this is a further supplement, which
passed December session, eighteen hundred and thirty-
seven, chapter three hundred and ten, be and the same is
hereby declared to be in full force and effect upon the wa-
ters of Herring Bay and its tributary streams.

SEC. 2. Be it enacted, That the true intent and meaning
of the fourth section of the act passed December session,
eighteen hundred and thirty-seven, chapter three hundred
and ten, entitled, a supplement to the act passed Decem-
ber session, eighteen hundred and thirty-three, chapter two
hundred and fifty-four, is, that the shore of the said wa-
ters extends to low water mark.

SEC. 3. Be it enacted, That it shall not be lawful for any
one in cleaning or triming oysters, to throw the shells in
any of the aforesaid waters; and any one who shall be de-
tected in violating this provision, shall be liable to all the
penalties of the act to which this is a supplement.
