of such person or persons, with such security as he may deem sufficient, in the sum of six pounds
current money, conditioned, that the principal shall make his personal appearance at the next coun-
ty court of the county where the said justices shall reside, and not depart the said court without
leave thereof; provided, that nothing herein contained shall be deemed, construed or taken, to pro-
hibit the maker, distiller or brewer, of any spirituous liquors, beer or cider, from retailing the same
in such manner as is prescribed by law.

CHAP.
XXXI.

III. AND BE IT ENACTED, That it shall be the duty of the constables, in their respective comi-
ties, to make strict inquiry, and to call on all persons who do not reside in their respective counties,
and who are retailing any of the liquors above mentioned, for their licence or permit, and upon his
or their refusal to produce the same, the said constables shall give information immediately to some
one of the justices of the peace, under the penalty of ten dollars, to be recovered before a justice
of the peace as other small debts are recovered.

IV. AND BE IT ENACTED, That all fines imposed by this act shall be paid to the clerk of the
county, who shall account for the same with the levy court thereof, to be applied towards paying
the county charges.

CHAP. XXXII.

Fines to be
paid, &c.

An ACT to make public a road in Prince-George's county.

WHEREAS it is represented to this general assembly, by the petition of sundry inhabitants of
Prince-George's county, that it will greatly conduce to the convenience of the people of
that part of said county, to make public the road leading from Spalding's tavern to the district
of Columbia; and the prayer of the petitioners appearing reasonable, therefore,

Preamble.

II. BE IT ENACTED, by the General Assembly of. Maryland, That John Evans, Francis Tolson and
Philip Spalding, be and they are hereby appointed commissioners, and they, or a majority of them,
are hereby authorised and empowered to review the private road now leading from Spalding's ta-
vern, in Prince-George's county, to the district of Columbia, through the lands of Thomas Haw-
kins Hanson, and to lay out, survey, mark and bound the same, not exceeding thirty feet in width,
and to make a plot of the said road, when so laid out, surveyed, marked and bounded, and return
the same, under their hands and seals, to the clerk of Prince-George's county, to be by him record-
ed among the land records of the county; and the levy court of said county, at any meeting after
the said plot shall have been recorded, are hereby authorised and empowered to appoint a supervisor
or supervisors, to keep said road in repair as other public roads are in said county; and the said le-
vy court are hereby further authorised and empowered, to levy and assess, upon the assessable pro-
perty of said county, at the time of laying their next county levy, a sum of money in their opinion
sufficient to pay the expence in opening the said road.

III. AND EE IT ENACTED, That the said commissioners, or a majority of them, shall ascertain
and value the damages which any person or persons may sustain through whose land the said road
may pass, by opening and clearing the same, and shall make, and return to the levy court of Prince-
George's county, a certificate of such valuation, the amount of which shall be levied by said court
on the assessable property of said county, and paid to the person or persons entitled thereto.

IV. AND BE IT ENACTED, That the said commissioners, be allowed the sain of two dollars each
per day as. a compensation for their services.

V. AND BE IT ENACTED, That the said road shall not run through the house, yard, garden, or-
chard or meadow, of any person or persons, without the consent of such person or persons.

CHAP. XXXIII.

Not to go
thro' any
house, &c.

An ACT authorising Nathaniel Rochester, late sheriff and collector
of Washington county, to complete his collection.

Jan. 1807.

WHEREAS it is represented to this general assembly, by the petition of Nathaniel Rochester,
late sheriff and collector of Washington county, that from various causes therein set forth
he has not been able to complete his collection within the time limitted, and that there is still due
to him, as sheriff and collector of said county, considerable sums of money, and praying that a law
may pass to enable him to collect the same; therefore.
