aforesaid where a public road from Lancaster passes through said land, and return the certificate of
survey thereof to the clerk of Cecil county court, to be by him recorded; and the said road, when
opened, and the survey recorded as aforesaid, and the valuation herein after directed shall have
been paid, or secured to be paid, shall far ever thereafter be deemed a public highway, and kept in
repair in the same manner as other public roads in said county are kept in repair.

III. AND BE IT ENACTED, That the commissioners aforesaid, or a majority of them, shall ascer-
tain and value the damages that may be sustained by each and every person or persons through
whose land the said road may pass, by opening the same, and the valuation shall be made, and the
amount thereof paid to the parties respectively interested, before the said commissioners, or a ma-
jority of them, shall proceed to open the said road.

IV. AND BE IT EXACTED, That the said commissioners may appoint one of their number as
treasurer, and give him a certificate, under their hands, of his appointment, who is hereby empow-
ered to collect and receive the money that may be subscribed, for the purpose of paying, the damages,
labourers, and other necessary expences, of opening the said road, and such subscribers are hereby
directed to pay their several subscriptions to the treasurer appointed as aforesaid; and if any sub-
scriber shall neglect or refuse to pay the amount of his subscription, the said treasurer may and
is hereby authorised to sue for, recover and receive the same, and the said monies, when recovered,
shall be applied by the commissioners, or a majority of them, for the purposes contemplated by this
act; provided nevertheless, that the said road shall not be laid out or opened through any garden.

XLVI

CHAP. XLVII.

An ACT for an addition to the town of Rockville, in Montgomery
county.

WHEREAS Elizabeth Crabb, of Montgomery county, hath by her petition set forth, that her
children, heirs of the late Jeremiah Crabb, hold lands adjoining to the town of Rockville,
in Montgomery county, the value of which would be greatly enhanced by laying off eight acres,
part thereof, into lots; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That Thomas P. Wilson, Lewis Beall
and Richard West, be and they are hereby appointed commissioners, and the said commissioners, or
a major part of them, be and they are hereby authorised and required, at any time before the first
day of November, eighteen hundred and six, to cause eight acres of land, adjoining the town afore-
said, or such part thereof as they may think necessary, to be surveyed and laid out into lots, streets,
lanes and alleys, at the-proper cost and expence of the said Elizabeth Crabb, in such manner as to
the said commissioners, or a majority of them, shall appear convenient.

III. AND BE IT ENACTED, If any of the commissioners shall die, refuse, neglect, or be ren-
dered incapable to act, the remaining commissioner or commissioners may appoint some other per-
son in the place of the person or persons who shall so die, refuse, neglect, or be incapable to act.

IV. AND BE IT ENACTED, That each of. said commissioners shall be allowed two dollars per day
for each day they shall attend as commissioners aforesaid, and that the surveyor shall be allowed two
dollars per day for each and every day he shall be employed for the purpose aforesaid.

V. AND. BE IT ENACTED, That the commissioners aforesaid, or a major part of them, shall, on
or before the first day of March, eighteen hundred and seven, cause a correct and accurate survey
and plot to be made of the said land, or so much thereof as shall be. deemed necessary to be laid off,
and all the lots, streets, lanes and alleys, which shall be laid out in virtue of this act, and the said
lot shall be recorded amongst the records of the said, county as soon as conveniently may be there-
after, there to remain as; evidence of the boundaries, situation and location,, of the said lots, and of
the streets, lanes and alleys, which said streets, lanes and alleys, hereafter to be laid our in pursu-
ance of this act, shall be highways, and be so deemed and taken, to all intents and purposes what-
soever, and when, the same shall be done, the said land so surveyed and laid out, shall be and is
hereby declared to be part of the town of Rockville, as fully and amply as if originally included
therein, and shall have the same immunities and privileges as the rest of the said town now hath, or
in any former laws ought to have, saving to the state of Maryland, and all bodies politic and corpo-
