1805.

C H A P. XIX.

A Supplement to an act, entitled, An act to establish a market, and
to build a market-house, in the western precincts, of Baltimore,
and for the regulation of the same.

BE IT ENACTED, That Daniel Lammot, Christopher Johnson, Ebenezer Finley, Lewis Pascault,
John S. Horn, Luke Tiernan and John Kennedy, be and are hereby appointed commissioners
of the western precincts market, and the said commissioners, or the major part of them, and their
successors duly chosen, are hereby authorised and empowered, from time to time, to make rules and
regulations for the good order; government and well being, of said market, and to establish fines,
forfeitures and penalties, upon each and every person who may offend against such rules and regu-
lations, provided no fine shall exceed five dollars for each offence, and in their discretion to remit
the same; provided always, that the said rules and regulations be published at least three several
weeks in one of the daily news-papers in the city of Baltimore, and posted in several places of
the said market-house, before they be carried into effect; and full power and authority is hereby
granted to said commissioners, in the name of The Commissioners of the Western Precincts Mar-
ket, to recover before a single justice of the peace all fines, forfeitures and penalties, as small
debts are recoverable, and in like manner to bring action or actions in Baltimore county court
against any person or persons who may do any injury to the market-house, stalls, or other pro-
perty belonging or attached to said market, all fines and forfeitures to be applied to the use of said
market.

II. AND BE IT ENACTED, That the said commissioners shall be elected biennially, on the first
Monday in February, by the legal voters of the western precincts, the first election of said commis-
ioners to take place on the first Monday of said month, in the year eighteen hundred and seven, and
bienially for ever thereafter; and in case of a vacancy by death, resignation or otherwise, in the
board of commissioners, they, or a major part of the whole number of such commissioners, shall
forthwith proceed, by ballot, to fill such vacancy.

III. AND BE IT ENACTED, That it shall and may be lawful for the levy court of Baltimore coun-
ty, and they are hereby directed and required, at their session next preceding the said election, to
appoint three fit and proper persons to superintend and judge the said election, any two of whom
shall be a quorum, which said judges shall appoint a clerk to take the ballots, and it shall be the
duty of the said judges to give public notice in one or more of the news-papers of the city of Balti-
more, five several days, of the time and place of holding said election.

IV. AND BE IT ENACTED, That it shall not be lawful for said commissioners to make any charge,
or claim any rent, for any stalls to be erected or established under the sheds, and without the sham-
bles of the said market-house, but the same? if established,: shall be free from any toll or charge

whatsoever.


V. AND BE IT ENACTED, That the northern and southern lines of the streets binding on each
side of the market-house aforesaid, be and hereby are established the northern and southern limits
for boundaries of the said market, and the western line of Eutaw-street, intersecting the streets
aforesaid, be. the eastern limit or boundary of said market, and the western line of Green or Union-
street, intersecting the aforesaid streets, shall be the western limit or boundary of said market, and
within the said space or boundaries herein described the rules and regulations aforesaid, which may
be established, shall have full force and effect.

VI. AND BE IT ENACTED, That the said commissioners be and they are hereby empowered to
establish hay-scales within or near the market-space aforesaid, and appoint a weigher thereto, pro-
vided said hay-scales be under the same regulations, which are and hereafter may from time to time,
established by the mayor and city council of Baltimore, and a certificate from the weigher, when
appointed, shall be evidence of the weight of all hay by him so certified, and it shall be lawful as
well for all persons residing in the city of Baltimore, as all others, to purchase all or any hay weigh-
ed at said scales.

VII. AND BE IT ENACTED, That so much of the act to which this is a supplement as is contrary
to, and inconsistent with, the provisions of this act, be and the same is hereby repealed.
