ever so requested by any of the Commissioners. In all Court
proceedings under or pursuant to this Article, the decision
of the Commission shall be prima facie correct and the
burden of proof shall be upon the party attacking the same.
SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1953.

(House Bill 541)
AN ACT to repeal and re-enact, with amendments, Section
566 of Article 27 of the Annotated Code of Maryland
(1951 Edition), title "Crimes and Punishments", sub-
title "Refuse—Throwing or Dumping", providing that
any agency or department having zoning or planning
powers in a particular area shall have concurrent powers
with the County Commissioners in MAY BE DESIG-
NATED BY THE COUNTY COMMISSIONERS TO
EXERCISE THE POWERS HAD BEEN HEREIN
CONFERRED CONCERNING regulating and per-
mitting the dumping of refuse, trash, junk or motor
vehicles and providing further that Wicomico County
shall be included within the provisions of said section.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 566 of Article 27 of the Annotated
Code of Maryland (1951 Edition), title "Crimes and
Punishments", sub-title "Refuse—Throwing or Dumping",
be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:
566. It shall be unlawful for any person, firm or cor-
poration, either to maintain or permit to be maintained
outside of any incorporated municipality a junk yard, a
public dump or a lot on which refuse, trash or junk is
deposited or motor vehicles are dismantled or stored within
five hundred (500) feet of a public highway or within five
hundred (500) feet of the residence of another, or for any
