persons receiving the highest number of votes for the
respective offices voted upon elected, and shall record a
copy thereof among their proceedings.
In the event of a tie vote for any office, there shall be
an election on the fourth Monday in May for the office or
offices so tied. The terms of all elective officers shall begin
on the first Monday in June next succeeding the election.
The Mayor and Councilmen elected in May, 1936, and those
elected to fill said offices hereafter shall each serve for two
years or until his, or their, successor, or successors, shall
have qualified.
1239. On the same day on which the Mayor and Com-
mon Council is to be elected under this sub-title, and on
each and every first Monday in May in every other year
after the year 1936, said election on the first Monday in
May, 1936, to be held as provided by the provision of the
law existing at this time, one person, a legal voter in said
town, and owner of real estate to the value of at least one
thousand dollars, shall be chosen by the voters of said town
as its Treasurer, the person so elected in May, 1936, and
elected in every other year thereafter as herein provided,
to serve for two years, and until his or her successor shall
qualify, but before said Treasurer shall enter upon the
duties assigned, he shall [give] execute and deliver a bond
payable to the Mayor and Common Council of Seat
Pleasant, [in such penalty as the Mayor and Common
Council may fix, with securities to be approved by them,
conditioned as they may direct] at the cost and expense
of the town, payable to the Mayor and Common Council of
Seat Pleasant in the penalty of Five Thousand Dollars
($5, 000. 00), the sureties to be approved by the Mayor and
Common Council and conditioned upon the faithful per-
formance of the duties of his office, and the said Treasurer
shall qualify and enter upon the duties of his office on or
before the first Monday in June succeeding his election,
and a failure to qualify within the time herein specified
shall be deemed a refusal to accept the office, whereupon
the Mayor and Common Council shall order a new election
to fill the vacancy, such election to be held in the manner
prescribed by Section 1237 hereof. In the event of the
death, resignation, inability to act, or removal for cause
of the Treasurer by the Mayor and Common Council, it
shall be its duty to appoint another Treasurer under like
conditions as to bond, to serve until the next succeeding
town election at which his successor[s] shall be chosen to
serve until the expiration of the next regular term of
