permanently or otherwise employed, to act as an exam-
iner to conduct hearings upon any matter over which
the Commission has jurisdiction.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 8 of Article 78 of the Annotated Code of
Maryland (1951 Edition), title "Public Service Commis-
sion", he and the same is hereby repealed and re-enacted,
with amendments, to read as follows:
8. Whenever a hearing is held which relates to [the
issuing, granting, protection, suspension or revocation of
any permit or permits for the operation of any motor
vehicle or motor vehicles] any matter over which the Com-
mission has jurisdiction, the Commission may authorize
any officer or employee of the Commission, whether per-
manently or otherwise employed, and deemed by it to be
qualified, to act as an Examiner to hold such hearing, and
such officer or employee shall have power to administer
oaths, examine witnesses and receive evidence. Upon com-
pletion of the hearing the officer or employee holding the
same for the Commission shall submit to the Commission
his findings and his recommendations thereon, which find-
ings and recommendations shall be considered by the
Commission and such action taken with respect thereto, by
the Commission, as it shall decide to be proper.
SEC. 2. And be it further enacted, That this Act is
hereby declared to be an emergency measure and necessary
for the immediate preservation of the public health and
safety and having been passed by a yea and nay vote,
supported by three-fifths of all the members elected to each
of the two Houses of the General Assembly of Maryland,
the same shall take effect from the date of its passage.
