the property of another without the consent of the
owner, or upon any public highway of Prince George's
County.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That a new section be and it is hereby added
to the Code of Public Local Laws of Prince George's
County (1943 Edition), being Article 17 of the Code of
Public Local Laws of Maryland, title "Prince George's
County, " said new section to be known as Section 1202 of
the said Code and to follow immediately after Section 1201
of said Code, to be under the sub-title "Roads, " and the
sub-heading "Refuse, " and to read as follows:
1202. It shall be unlawful for any person to throw, dump
or deposit any trash, junk or other refuse upon the land
or property of another without the written consent first
had and obtained of the owner thereof, or under the per-
sonal direction of such owner; or to throw, dump or de-
posit any trash, junk or other refuse upon any public
highway of Prince George's County, and any violation of
this section shall constitute a misdemeanor and any person
convicted thereof before a Trial Magistrate or Court of
proper jurisdiction shall be punishable by a fine of not
less than Two Hundred Dollars ($200. 00) or more than
One Thousand Dollars ($1, 000. 00) or by imprisonment of
not less than thirty (SO) days or more than ninety (90)
days, or both. Provided, that if it shall appear that any
person so convicted has previously been convicted of a vio-
lation of this section, the Court, or Trial Magistrate, pre-
siding in the case, shall impose a sentence of imprisonment
for not less than thirty (30) days.
SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1953.
