entrances, guard rails, retaining walls, sodding and plant-
ing.

528B. (108-13B) Participation in cost of private de-
velopments.

After the adoption of a resolution or ordinance by the
Town Council to that effect, the Mayor on behalf of the
Town may enter into a written contract with any person,
firm or corporation who is engaged in promoting a real
estate development or sub-division in the Town, to partici-
pate in the cost of street, sidewalk, gutter, curb or drain-
age construction in a public street or road dedicated to
the public use.

528C. (108-1SC) Permits required; penalties for viola-
tions.

a. Before any street, sidewalk, gutter, curb, grading
project or drainage project may be begun on a Town road
or street or within the boundaries of a dedication to the
public use, the applicant for a permit to undertake any
such project shall pay to the Town as an inspection and
engineering fee such fee or fees as may be provided by
rule, regulation or ordinance adopted by the Town Council
for the construction of any such street, sidewalk, gutter,
curb, grading project or drainage project.

b. Any person who violates any provision of this section
shall, upon conviction be fined not more than $1, 000. 00, or
imprisoned for not more than one year, or both, for each
offense.

528D. (108-13D) Construction of roads by Town—Reso-
lution of Town Council required; assessment of benefits,
in general.

No road shall be constructed by Garrett Park, Maryland,
except pursuant to a resolution of the Town Council
adopted at a regular or special meeting authorizing the
Mayor to construct such road. Whenever any road in Gar-
rett Park is so authorized to be constructed the cost of
construction shall by ordinance enacted by the Town
Council be assessed as a benefit to all property abutting
the road, provided that—

a. Such cost of construction shall be assessed only to the
extent that any Road Construction Code of Garrett Park
in force at the time of enactment of such ordinance of as-
