eliminating from said section the provision relating to
the amount of special tax which may be collected for the
removal of refuse and garbage in the Town of Somerset.

SECTION 1. Be it enacted by the General Assembly of
Maryland,
That Section 1152 of the Code of Public Local
Laws of Montgomery County (1947 Edition, being Article
16 of the Code of Public Local Laws of Maryland), title
"Montgomery County, " sub-title "Somerset, " said section
being Section 114-22 in the Montgomery County Code of
1950, be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

1152. The Council may adopt suitable measures for the
removal of refuse and garbage by a special tax for that
purpose, to be imposed on the occupants of the respective
premises and collected thereupon, provided that the owners
of said property shall be responsible for said tax in case
the same cannot be collected from the occupants of the
premises in question, and it shall be a lien on said property
and collected as other taxes are collected; and the Council
may pass suitable ordinances to enable the proper official
or officials to collect and remove all filth from the town
and provide for the disposal thereof. [The special tax pro-
vided for in this section for the purpose aforesaid shall not
exceed the sum of Fifty Cents per month on any one
dwelling. ]

SEC. 2. And be it further enacted. That this Act shall
take effect June 1, 1953.

(House Bill 37)

AN ACT to repeal and re-enact, with amendments, Section
138 of Article 16 of the Annotated Code of Maryland
(1951 Edition), title "Chancery, " sub-title "Non Compos
Mentis, " authorizing the sale or mortgage of real prop-
erty by a competent spouse after his or her spouse has
been adjudicated a lunatic, and providing for power of
the Court in releasing dower rights.
