and prosecuted to final determination and judgment as if
this charter had not become effective, with the right in the
council to settle, compromise or adjust any outstanding
claims due the city.

EXISTING LAWS:

108. All laws in effect at the time this charter is adopted
relating or applicable to the City of Frostburg which are not
inconsistent with this charter shall remain in effect until
changed or repealed by the General Assembly of Maryland.

EXISTING ORDINANCES:

109. All ordinances, resolutions, rules, and regulations
in effect in the city at the time this charter is adopted and
which are not in conflict with the provisions of this charter,
shall remain in effect until amended, altered, or repealed
according to the provisions of this charter.

DAMAGES:

110. Before the City of Frostburg shall be liable for
damages of any kind, the person injured, or someone in his
behalf, must give the clerk notice in writing of the injury
within thirty days after the injury has been received, stat-
ing specifically when, where and how the injury occurred
and the extent of the injury. The City of Frostburg shall
never be liable on account of damage or injury to any per-
son or property arising from or occasioned by any public
way or public grounds or any defect thereon, any accumu-
lation of ice or snow, or any public work of the city unless
the specific defect or the accumulation of snow or ice
causing the damage or injury shall have been actually
known to the Mayor or City Engineer by personal inspec-
tion for a period of at least twenty-four hours prior to the
occurrence of the injury or damage, or unless the attention
of the Mayor and/or City Engineer shall have been called
thereto by notice in writing at least twenty-four hours prior
to the occurrence of the injury or damage and proper dili-
gence has not been used to correct the defect or cause said
accumulation of snow or ice to be removed after actually
known or called to the attention of the Mayor and/or City
Engineer as aforesaid.

MISDEMEANORS:

111. Every act or omission designated as a misdemeanor
in this charter, unless otherwise provided shall be punish-
